states on oath I am an engine driver
in Charters Towers. I know Defdt he lives near the Day Dawn PC.
I was at his house on the 18 June last about 4 o.'c. p.m. I remember
that day because I was day shift. I went to his house to make an
estimate for timber for sale. I knocked off work at 4 o.'c. that
day. I went to my house close to Defendants first, and then
went to Defdts house and saw him there. We did our business
and he made me out an estaimate. I left his house at close
up 5 o.'c. I mean by that a minute [insert] or two [end insert] before or after 5 o.'c.
Defdt had half dirty clothes on, moleskin. I am certain Defdt
could not have been in Lissner Park between1/2 past 4 and 5 o.'c.
that evening. That was the only afternoon I went to see him about
the estimate

It may have been a 1/4 to 5 when I left Defendants
I made no note of the time. I dare say I could wal from his
house to Lissner Park in ten minutes. I could not say if
Defdt could have been in Lissner Park at 5 or 10 minutes past
5 that afternoon. If he had gone straight away from the last
time I saw him he could have been in Lissner Part at 20 past
5 o.'c. I won't swear Defdt was not in Lissner Park between 5 & 20
minutes past 5 that afternoon.

I saw Defdts brother Anthony Wiederkehr coming
towards Defdts house that afternoon as I was leaving, he was
coming from work.

Miners at Mills United knocked off at 1/2 past 3.
Engine Drivers knocked off at 4 o.'c. but on Mondays we are not particular
as to 5 or 10 minutes. We go by Post Office time. Weiderkehr's brother was
working at house painting about 150 yards from Defdts house. I believe we
knocked off at 5 to 4 o.'c. that afternoon, and I saw Defdt coming through the
yard with his tools anbout 20 to 4. Defdt made the estimate with me that afternoon
in his front rooms. He was about 7 minutes walk from Mills United.
