[Several other documents were read and produced. some of which defendant remembered seeing.] Saw so many papers that I did not take notice of the dates, as it was no interest to me; the words alia Scott were inserted in the charge- sheet after Silberman was discharged; I told Doran to do it; Doran sig[n]ed my name for me in the char[g]e-sheet; the apprehending con- stable should sign it; did say at the Police Court to plaintiff that I had to apprehen[d] him on suspicion to enable me to have a look at his jewellery; noticed the date of pawn ticket was the 6th March; know there are many robber[i]es in Brisbane; know that it could not belong to the robbery on the 7th of April; the reason I sent the wire to the Police Department about the pawn ticket was for them to make inquiries about whether these pawned watches were amongst the stolen property of the 7th; the reason I underlined the receipt given to plaintiff about his property was mere pastime; it is not usual for me to underline public docu- ments; never said to Barnett that I have found credit slips to the amount of £2000 in plaintiff's bag; said I found a hammer and chisel and a pawn ticket; Barnett said to me "You may have one of the ring, but not the actual burg- lar;" it would take seven days to go from Sydney to Cooktown; it is usual to examine prisoners whether they are quilty or not; did not produce hammer and chisel at police court; only stated I found them. Cornelius Doran, lockup keeper, deposed: Was at the lockup on the 10th May between 12 and 1 ; the sergeant brought Silberman to the lockup, and locked him up, whom I searched; entered the charge in the charge- book; the bags and box of Silberman were ex- amined, and the sergeant made an inventory; the effects were locked again and I had charge of the keys; I asked the sergeant should I enter "alias Scott" to Silberman's name on the charge-sheet ; he said "do so," and I wrote it in accordingly ; consider plaintiff was treated very well in lockup; he had three pairs of bouble blankets in the cell. By Mr. Power: Make a return every week to the sergeant about rations, &c.; heard Silber- man was charged in Court with "alias Scott;" if the sergeant said the entry in the charge- sheet was made after the plaintiff was dis- charged he was wrong; I said, after examining the documents with the sergeant, that his name must be Silberman. as receipts and other documents go to prove it; the book pro- duced is the one put before the Bench; plain- tiff said at the lockup that he missed two gold watches and a diamond ring; defendant looked carefully at the papers and documents belong- ing to plaintiff; did not see anyone underline the words on receipt; Kenna did not have hold of plaintiff when I saw him with the sergeant; plaintiff was not resisting arrest; he com- plained in the cell on the same day about his foot being injured; he said he would like to see Dr Browne; told the sergeant that Silberman 6.
