Sir,
I have the honor to acknowledge
the receipt of your memorandum of the
20th inst, submitting for my opinion
the papers connected with the case noted
in the margin [written in margin: Regina v Billy Horton], as to whether the
supplementary evidence of Mr Daveney, is
such, as His Honor the Judge in his
letter of the 19th inst remarks to be
wanting.
The supplementary evidence of Mr Daveney
is not of that character which would in
my opinion be received with any weight
by the Judge. I have therefore written
to the Police Magistrate at Ipswich, instructing
him to examine Mr Daveney on oath, on
the point referred to by His Honor the
Judge.
This examination when received together
with the examination of Mr Mills should
be transmitted to the Judge for his
perusal.
