Constable Wm Carson being duly sworn states _ I am a Sergeant in the IpswichPolice Force, on the morning of Thursday the tenth instant I was at Fassifern _ I had gone up the previous day to serve a Summons upon Mrs Hardie and another one James Bennett Known as Bother George _ but in the Summons he was named James Bennett _ Mr Hardie said he was not in their employ , he had discharged him sometime ago _ and wished he would leave the place altogether _ he and Mr Mienholt said it was no use going to look for him in the bush for I Should not find him _ Mr Hardie said he expected him at that Station on the following evening either with a flock of Sheep he was to [to the somewhere] [struck out & initialled H.C.] bring from somewhere or to take some where _ or [from] [struck out & initialled H.C.] after having taken a flock of Sheep somewhere _ I cannot say which _ but he said if I would leave the Summons with him he would give it to him himself _ The evening before he [also] [inserted & initialled H.C.] asked to give him the Summons and he would serve [it upon him[ [inserted & initialled H.C.] but I refused saying I would rather serve it personally my self if I could find him _ he said [he could no] [struck out & initialled H.C.] in reply that he could not tell where I could find him _ When [I asked Mr Hardie did] [struck out & initialled H.C.] Mr Mienholt told me on Thursday morning that he could not tell me where I could find him I went to Mr Hardie and and left the Summons with him, he took the Summons from me and promised to Serve it upon James Bennett when he James Bennett returned [the following evening ]struck out & initialled H.C.] _ [on] [struck out & initialled H.C.] the Summons was returnable on Saturday the [tenth] [struck out & initialled H.C.] twelfth instant. [Signed] William Carson Taken and acknowledged upon oath before me at my residence this twenty eighth day of January 1861 [Signed] Henry Challinor J.P. Edward Quinn being duly sworn states I am Chief Constable of the Ipswich Police Force _ I was present when Henry Challinor Esq. J.P. requested $ Lucas on the evening of the Second instant to accompany him to [hol] [struck out & initialled H.C.] Fassifern to [hold] [struck out & initialed H.C.] [attend] [insert & initialled H.C.] a magisterial equiry respecting the death of the three aboriginals who were then lying dead in the Scrub adjoining the head Station Fassifern_ Dr Lucas said "I Cannot go there tonight for [only] [struck out & initialled H.C.] I have only just returned from there and my horse is Knackered up _ If I had Known you were going up I would not have come down _ while I was there I told Mr Hardie that there was a report that some blacks had been Shot there, and that [you would be hope] [struck out & initialled H.C.] Dr Challinor would be going up to hold an inquest upon them _ and [that] [struck out & initialled H.C.] Mr Hardie replied that there would be no inquest there for there had been no blacks Shot." this conversation was addressed to Dr Challinor [Signed] Edward Quinn Taken and acknowledged upon oath before me at the residence of the Chief Constable of Ipswich this twenty eighth day of January 1861 [Signed] Henry Challinor J.P.
